Terms and Conditions relating to The Milking Parlour at Hole

By booking, it will be considered that you are fully conversant and have agreed to all the below terms & conditions

1. Booking and Payment
 
 Bookings can only be accepted from persons over 18 years of age and by paying the deposit, the client acknowledges that he or she agrees to the Terms and Conditions on behalf of the total party intending to occupy the property.

 Reservations will be held as a provisional booking for 7 days or until a deposit of one-third of the cost is received. Cheques should be made payable to The Hole of Devon.   Once the booking form and deposit are received, the balance is due 4 weeks before commencement of the holiday.  No reminder will be sent and we reserve the right to cancel the booking if the balance is not paid by the due date.  If a booking is made less than 4 weeks before arrival, the full cost is due at the time of booking.

2. Cancellation

 All cancellations must be notified in writing.  We will endeavour to re-let the property.  If successful, all money paid will be refunded, less £30 expenses for re-letting.  If we are unable to re-let the property, you are liable for the full balance outstanding.  Cancellation insurance is strongly recommended.

3. Non-Availability of Property

 If for any reason beyond our control, for example fire damage, the property is not available on the date booked, all monies will be refunded in full and we will not be liable for any further claims.

4. Arrival and Departure

 The Milking Parlour at Hole will be available for occupancy from 3pm on the day of arrival and should be vacated by 10.30am on the day of departure.

5. Your Responsibilities

 You are responsible for the property during your stay, and it should be left in the clean and tidy condition at the end of your holiday that you found it in at your arrival, with all furniture, fixtures, fittings and effects remaining in the property, as at the commencement of the holiday.  Any damage or breakages will be charged and must be reported to us as the owners prior to departure.  No attempt should be made to repair or replace items.

 This agreement is made on the basis that The Milking Parlour at Hole is to be occupied by yourself as the holidaymaker for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the holidaymaker acknowledges that the tenancy granted by this agreement is not an assured tenancy or any other type of tenancy and that no statutory periodic tenancy will arise when it ends.

 We cannot accept any responsibility for personal injury to you as guests or holidaymakers or loss of damage to your property or for other matters over which we have no control. 

Please be aware that a farm can be a dangerous place with open water, holes, steps, a well etc and by accepting and booking, you agree to accept responsibility for the physical well being of you and your party, indemnifying us from all responsibilities, blame and consequences should someone injure themselves.

  •  The total number staying in The Milking Parlour at Hole must not exceed 5 persons.
  • Smoking is NOT permitted in The Milking Parlour at Hole at any time.
  •  No pets are allowed in The Milking Parlour at any time (sorry!).
  •  Please be considerate and do not cause an annoyance or become a nuisance to other residents and visitors at Hole.
  •  The owners reserve the right to reasonable access of the property at any time for emergency maintenance etc.

6. Discrepancies

 In the case of a discrepancy between these Terms and Conditions and any other information about The Milking Parlour at Hole, these Terms and Conditions shall prevail.

7. Breach of these Terms and Conditions

If you commit a serious breach of these Terms and Conditions we as owner will have the right to terminate your booking and we may require you to vacate immediately and no refund of the fees you have paid will be returnable to you.

8. Law

English law is to prevail, and where any conflict between terms and conditions occurs, these terms and conditions prevail.
