Terms and Conditions relating to The Milking Parlour at Hole
By booking, it will be considered that you are fully conversant and have agreed to ALL the below terms & conditions:-
1. Booking and Payment
i. Bookings can only be accepted from persons over 18 years of age and by paying the deposit, the client acknowledges that he or she agrees to these Terms and Conditions on behalf of the ENTIRE party intending to occupy the property under
ii. Reservations will be held as a provisional booking for 7 days or until a deposit of one-third of the cost is received. Cheques should be made payable to ‘The Hole of
Devon ’. Once the booking form and deposit are received, the balance is due 4 weeks before commencement of the holiday. No reminder will be sent and we reserve the right to cancel the booking if the balance is not paid by the due date. If a booking is made less than 4 weeks before arrival, the full cost is due at the time of booking.
i. All cancellations must be notified in writing. We will endeavour to re-let the property. If successful, all money paid will be refunded, less £30 expenses for re-letting. If we are unable to re-let the property, you are liable for the full balance outstanding. Cancellation insurance is strongly recommended.
3. Non-Availability of Property
i. If for any reason beyond our control, for example fire damage, the property is not available on the date booked, all monies will be refunded in full and we will not be liable for any further claims.
4. Arrival and Departure
i. The Milking Parlour at Hole will be available for occupancy FROM 3PM on the day of arrival and MUST BE VACATED BY 10.30AM on the day of departure.
5. Your Responsibilities
i. You are responsible for the property during your stay, and it should be left in the clean and tidy condition at the end of your holiday that you found it in at your arrival, with all furniture, fixtures, fittings and effects etc remaining in the property, as at the commencement of your holiday. Any damage or breakages will be chargeable, and must be reported to us as the owners as soon as possible, and always prior to departure. No attempt should be made to repair or replace items.
ii. This agreement is made on the basis that The Milking Parlour at Hole is to be occupied by yourself as the holidaymaker for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the holidaymaker acknowledges that the tenancy granted by this agreement is not an assured tenancy or any other type of tenancy, and that no statutory periodic tenancy will arise when it ends.
iii. We cannot accept any responsibility for personal injury to you as guests or holidaymakers, or loss of damage to your property or for other matters over which we have no control.
iv. Please be aware that a farm can be a dangerous place with open water, holes, steps, a well etc and by accepting and booking, you agree to accept responsibility for the physical well being of you and your party, indemnifying us from all responsibilities, blame and consequences, direct and indirect however arising, should someone injure themselves at our premises or in using any articles provided at the Milking Parlour or inconvenience themselves in any way.
v. The total number staying in The Milking Parlour at Hole must not exceed 4 persons, and is the agreed number of people stated and accepted when booking the accommodation.
vi. Smoking is NOT permitted in The Milking Parlour at Hole at any time.
vii. No pets are allowed in The Milking Parlour at any time (sorry!).
viii. fireworks are not allowed at Hole due to possibly frightening livestock, and the easy ignition of the thatched roofs on site.
ix. Please be considerate and do not cause an annoyance or become a nuisance to other residents and visitors at Hole.
x. The owners reserve the right to reasonable access of the property at any time for emergency maintenance etc.
xi. We are delighted to offer free wireless access to the internet/world wide web as part of the package of benefits available to our guests, subject to the following provisions: (i) No web access or Peer to Peer file transfers of any kind will be made to or from any illegal or distasteful web sites, or other accessible locations/portals/file depositries via the services provided at Hole. (ii) That you fully support the aims and procedures of such bodies as Child Exploitation & Online Protection Centre (CEOP) and Internet Watch Foundation (IWF). (iii) That the use of the Internet and related facilities on site will not be used in any way for participation in any kind of illegal, distasteful or otherwise disreputable activity such as (but in no way exclusively)grooming, chat room/web cam activity, hacking, cyber bullying, fraud, financial scamming, identity theft, internet stalking, phishing, accessing any suicide/terrorism/violence/wildlife crime web sites. (iv) No attempt will be made to introduce or in anyway develop or send any malicious software, viruses, trojan horses, worms, spam email or any malware whatsoever of any kind, by using the services at Hole. (v) That no activities of any kind will be made in contravention to the Computers Misuse Act 1990, the Obscene Publications Acts 1959 & 1964 or the Criminal Justice & Immigration Act 2008 (vi) That any downloads made from legal sites will be fully paid for where appropriate by you the user to the supplier at that time. (vii) That the data transfers for the duration of your stay will be limited to a maximum of 2.5Gb as part of the standard benefits, downloads after this limit will be charged at £3 per Gb billable in 2 Gb files. (viii) That should the relevant authorities in this or other countries require your contact details in conjunction with downloaded files or behaviour related to your use of the internet at Hole, that we will and can provide those with your assumed permissions, without contravention of the UK Data Protection Act, or the EU Human Rights Act 1998.
i. In the case of a discrepancy between these Terms and Conditions and any other information about The Milking Parlour at Hole, these Terms and Conditions shall prevail.
7. Breach of these Terms and Conditions
i. If you commit a serious breach of these Terms and Conditions we as owner will have the right to terminate your booking and we may require you to vacate immediately and no refund of the fees you have paid will be returnable to you.
i. English law is to prevail.
9. Data Protection Act 1998
i. Any personal contact data requested & collected is solely for the satisfactory completion of the transaction between you as the holiday maker(s), and us as supplier of the premises. Your information is never provided to any other party or entity, and is only used in strict accordance with the UK Data Protection Act.
